3.1 NATURAL GEMSTONES

Many YÙIN pieces are made with natural gemstones.

As natural gemstones are formed by nature, each stone may naturally differ in:

• colour and tone;

• texture;

• clarity;

• shape and size;

• natural markings;

• inclusions; and

• other characteristics.

These variations are part of the natural character of the gemstone and are not necessarily considered defects.

No two natural gemstones are exactly alike, and the piece you receive may not look identical to the product photographs shown on our website.

3.2 PRODUCT PHOTOGRAPH

We make reasonable efforts to photograph and describe our products as accurately as possible.

However, the appearance of a product may vary depending on lighting, photography conditions, your device and screen settings.

Minor differences between the product shown on screen and the physical piece received do not necessarily constitute a defect.

3.3 PRODUCT INFORMATION

Product descriptions, measurements, materials, gemstone information and certification details are provided on the relevant product page where applicable.

You are responsible for reviewing the product information before placing your order.

The type of certification, issuing body and availability of certification may vary between products.

4. PRODUCT AVAILABILITY

All products are subject to availability.

Certain YÙIN pieces may be offered in limited quantities or may require additional preparation before shipment.

We reserve the right to limit the quantity of products available for purchase.

If we are unable to fulfil an order due to circumstances including availability, production, preparation or other reasonable causes, we will contact you and provide an appropriate resolution.

5. PRICES

All prices displayed on the YÙIN website are stated in Malaysian Ringgit (MYR/RM) unless otherwise indicated.

Prices may change from time to time without prior notice.

The price applicable to your order will generally be the price displayed at the time your order is placed, subject to any obvious pricing error or other circumstances permitted by applicable law.

We reserve the right to correct any typographical, pricing, product description or other errors appearing on our website.

If an obvious pricing error affects an order you have placed, we may contact you before fulfilling the order to clarify or resolve the matter.

6. ORDERS

6.1 PLACING AN ORDER

When you place an order through our website, you are submitting an offer to purchase the selected product or products.

After placing an order, you may receive an order confirmation by email.

An order confirmation acknowledges that we have received your order. It does not necessarily mean that your order has been finally accepted where there is an issue relating to product availability, payment, pricing, product information or other circumstances affecting fulfilment.

We reserve the right to decline or cancel an order where reasonably necessary.

6.2 ORDER CANCELLATION

Once an order has been placed, any cancellation request will be subject to our Return & Exchange Policy and the circumstances of the order.

Please contact us as soon as possible if you believe you have placed an order incorrectly.

You are responsible for ensuring that all information provided when placing an order is accurate and complete, including your:

• delivery address.

YÙIN is not responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete information provided by you.

7. PAYMENT

Payment must be successfully completed through the payment methods made available at checkout before your order can be processed.

The payment methods available may change from time to time.

Any payment provider or third-party payment service used during checkout may be subject to its own terms and conditions.

YÙIN does not control the independent policies, systems or practices of third-party payment providers.

8. ORDER PREPARATION & DELIVERY

YÙIN pieces may require a period of preparation before they are handed to the courier.

The applicable preparation and delivery information is provided in our Order & Shipping Policy.

Once your order has been shipped, tracking information will be provided where available.

Delivery dates and timeframes are estimates and may be affected by circumstances outside our reasonable control, including:

• courier delays;

• public holidays;

• severe weather;

• customs clearance;

• government restrictions;

• incorrect delivery information; or

• other unforeseen circumstances.

For international orders, customs duties, taxes, import charges or other fees may apply depending on the destination country. Unless otherwise stated, such charges are the responsibility of the customer.

9. RETURNS, EXCHANGES & WARRANTY

Our Return, Exchange & Warranty Policy sets out the conditions applicable to returns, exchanges, damaged items, workmanship issues and other after-sales matters.

Please refer to that policy for the applicable requirements and timeframes.

Nothing in these Terms is intended to exclude, restrict or replace any rights or remedies that cannot lawfully be excluded under applicable law.

Where YÙIN provides a voluntary exchange or warranty arrangement, that arrangement is provided subject to the relevant policy and does not limit any mandatory rights you may have under applicable law.

10. YÙIN REFRESH

YÙIN Refresh is a cleaning service offered exclusively for YÙIN pieces.

Where applicable, customers may send their YÙIN pieces back to us for cleaning for as long as they own the piece, subject to the applicable YÙIN Refresh terms.

YÙIN Refresh is intended for cleaning and care only and does not automatically include repairs, replacement of components, restoration or other services.

Any applicable charges or shipping costs will be communicated separately.

11. YÙIN CIRCLE

The YÙIN Circle is YÙIN's membership programme.

Participation in the YÙIN Circle is subject to the YÙIN Circle Terms & Conditions, which set out the applicable membership requirements, benefits, points, privileges and other conditions.

YÙIN Circle benefits are personal to the member and may not be transferred, sold or exchanged for cash unless expressly stated otherwise.

We reserve the right to refuse, suspend or terminate membership where there is reasonable evidence of fraud, abuse, misuse or breach of the the YÙIN Circle Terms & Conditions.

12. INTELLECTUAL PROPERTY

All content appearing on the YÙIN website is owned by YÙIN or used by YÙIN with permission, unless otherwise stated.

This includes, without limitation:

• the YÙIN name and logo;

• brand identity and visual elements;

• product names;

• collection names;

• photographs;

• videos;

• graphics;

• illustrations;

• website design;

• written content;

• product descriptions;

• packaging designs; and

• other creative materials.

All such content is protected by applicable intellectual property laws.

You may view and use the website for your personal, non-commercial purposes.

You may not, without our prior written permission:

• copy;

• reproduce;

• modify;

• distribute;

• publish;

• sell;

• commercially exploit; or

• create derivative works from

any YÙIN content or intellectual property.

You must not use the YÙIN name, logo or other brand elements in a way that suggests an unauthorised association, endorsement or partnership with YÙIN.

If you submit or provide content to YÙIN, including reviews, testimonials, photographs or other materials, you confirm that you have the right to provide that content.

By voluntarily submitting content for potential use by YÙIN, you grant YÙIN a non-exclusive, royalty-free right to use, reproduce and display that content for purposes relating to YÙIN, including our website, social media, marketing and promotional materials.

You remain responsible for ensuring that any content you submit does not infringe the rights of another person.

YÙIN reserves the right to remove or decline to publish submitted content at our discretion.

Nothing in these Terms excludes or limits any liability or responsibility that cannot lawfully be excluded or limited under applicable law.

To the extent permitted by law, and subject always to any mandatory consumer rights, YÙIN's liability in relation to a particular purchase will not exceed the amount paid for the relevant product.

These Terms of Use shall be governed by and interpreted in accordance with the laws of Malaysia.

Any dispute arising from or relating to these Terms shall be subject to the applicable laws and jurisdiction of Malaysia, subject to any mandatory rights or remedies available to consumers under applicable law.
